What National Fingerprint Laboratory Facilities Do and Do Not.
NFp’s laboratory facilities receive completed Self-capture™ Packs, promptly affirm the chain of custody is unbroken, affirm the packs are genuine, affirm client funds have been received to cover government fees if applicable, then process the packs into appropriate format for transmitting via proper channels to state or FBI repositories. Lab facilities protect and retain fingerprint records while their purpose is fulfilled, then destroy them in accordance with the National Institute of Standards and Technology Guide to Protecting Personally Identifiable Information as circulated by the FBI Compact Council.
Neither NFp nor its Lab facilities workers:
- View CHRI or receive dissemination they are not authorized by law or regulation to view or receive.
- Make any recommendations as to eligibility for employment, licensing, or permits.
- Render directly or by implication any legal advice or answers to questions involving interpretations of law.
- Make any direct or implied warranty about accuracy or completeness of data disseminated by, or accept any liability whatsoever for quality, timeliness, or performance of services by governmental or regulatory agencies.
- Warrant that any specific fingerprint impression is or can be made sufficiently legible to please its recipient.
- Prepare consumer investigatory reports as defined in the FCRA and related statutes.
What NFp and its Lab Facilities provide:
NFp furnishes a patent-pending Self-capture Pack containing materials, supplies, and instructions for individuals or groups guided by NFp-Registered Trusted Observers to create their own multifold biometric specimens (such as fingerprints) using proprietary patent pending Biometric Self-capture™ methods. When the lab facilities receive specimens they deem eligible for processing they furnish their best effort to transmit them in the required format and by the necessary means to the appropriate FBI or state authority for fingerprint-matching pursuant to a legal agreed purpose. Packs found by the Lab to contain print impressions of insufficient quality, impressions deliberately distorted or misprinted, lacking sufficient legible demographic data, or indicative of possible fraudulent activity, will be delayed until NFp in cooperation with the client and applicant corrects those deficiencies.
Limited Warranty
It is known that between 1% and 2% of the population cannot be fingerprinted because the skin patterns are either worn or too indistinct. Nevertheless, NFp warrants that the fingerprint specimens completed by an applicant in view of a registered Trusted Observer™ both of whom substantially obey the instructions, will result in a print record found legible by the intended recipient, or NFp at its sole option will collaborate directly with the applicant to obtain replacement specimens to resubmit. If the print record is still found illegible by the recipient NFp will provide credit for a free replacement Pack. NFp’s liability in any instance is limited to refunding the client's amount paid to acquire the Pack. NFp reserves the right to refund any unspent prepaid amounts it received and decline to process any more biometric specimens including fingerprints should the laws, rules, and governmental procedures on which it depends, in NFp’s sole opinion, change to materially hinder NFp's ability to perform its duties.
Positive identification of Applicants
NFp, state, federal, and channeler authorities rely upon NFp's Registered Trusted Observers (T-Os) to establish the identity of applicants from whom self-captured biometric specimens are collected, because
- NFp's client affirms they employ the T-O in an HR role that includes access to confidential personally identifiable information, or because
- The T-O is affirmed to be a professional notary public experienced at evaluating credentials and trusted by the state to authenticate signatures of parties engaged in substantial commercial transactions.
While NFp believes these authorities are justified in such reliance NFp does not warrant that positive identification necessarily occurred in any specific instance.
